Police: Man Assaulted Medical Personnel After Trespassing, Stealing Booze From State College Apartment

A Chester County man is facing charges for allegedly entering a State College apartment without permission, stealing liquor and later assaulting medical personnel after he was found intoxicated on a sidewalk.

Manuel A. Deleon-Garcia, 22, was charged Thursday with three felony and four misdemeanor counts stemming from the alleged incidents over State Patty’s weekend in the borough.

One resident of an East Nittany Avenue apartment saw via a Ring camera recording an unknown male enter the residence just before 1 a.m. on March 1 and notified her roommates, who were in their bedrooms at the time, according to an affidavit of probable cause filed by State College police. A review of the footage showed the man, later identified as Deleon-Garcia, stumble up the hallway and into the apartment, then leaving with a bottle of vodka and an eight-pack of lemonade vodka cans, police wrote.

None of the residents knew Deleon-Garcia nor gave him permission to enter the apartment, according to the affidavit. Police did not detail how he gained entry to the residence.

Less than an hour later, an officer found Deleon-Garcia unconscious on the sidewalk a few blocks away on West Hamilton Street, and police identified him as the same person who was seen in the apartment, according to the affidavit. After waking up, he showed signs of impairment, initially did not give his real name and tried to walk away, police wrote.

When an ambulance arrived to take him to Mount Nittany Medical Center for a possible overdose, Deleon-Garcia again tried to flee before being placed on a stretcher, according to the affidavit.

En route to the hospital, Deleon-Garcia became combative, striking an EMT in the leg and a doctor multiple times in the abdomen and shoulder, police wrote.

When an officer arrived at the medical center, Deleon-Garcia was “thrashing about” in his room and six security guards were needed to hold him down so nurses could treat him, according to the affidavit. A doctor ultimately determined Deleon-Garcia needed to be sedated and physically restrained for care to be administered, police wrote.

Medical records indicated Deleon-Garcia had a blood alcohol content of 0.40% at the time of treatment, according to the affidavit.

Deleon-Garcia was arraigned Thursday by District Judge Don Hahn on two sets of charges.

He is charged in the apartment incident with felony counts of burglary and criminal mischief and misdemeanor counts of prowling at night, theft and receiving stolen property. Unsecured bail was set at $42,500 for those charges.

Deleon-Garcia is also charged with felony aggravated assault of designated individuals, misdemeanor simple assault and a summary offense of public drunkenness. Hahn set unsecured bail for that set of charges at $20,000.

A preliminary hearing is scheduled for April 1.
